These Terms of Use ("Terms") govern your use of the Nightproof iOS app. By installing or using Nightproof, you agree to these Terms. If you do not agree, do not use the app.

What Nightproof is, and isn't

Nightproof is a self-help utility. It lets you voluntarily restrict access to apps you select, during scenarios you select, and gates re-access behind a short cognitive challenge. It is meant to be a friction layer between your sober self and your future drunk self.

Nightproof is not:

You are responsible for your decisions

You are solely responsible for which apps you choose to restrict, when you activate restrictions, and how you respond to the challenges. The cognitive challenges are casual, entertainment-style mini-games. They are NOT a clinical or scientific test of sobriety, impairment, or cognitive fitness. Passing or failing a challenge tells you nothing about whether you are safe to drive, operate machinery, or make other decisions. Never use Nightproof's challenge results to decide whether to drive, operate vehicles or machinery, or take any action where impairment matters.

No medical advice

Nothing in Nightproof constitutes medical, psychological, addiction-treatment, or legal advice. If you are struggling with substance use, please speak with a qualified professional. In the United States: SAMHSA's National Helpline, 1-800-662-HELP (4357), free and confidential, 24/7.

Purchases

Nightproof offers a one-time in-app purchase that unlocks premium features. Purchases are processed by Apple through the App Store and are subject to Apple's terms. Purchases are generally non-refundable except as required by law or Apple's policies; refund requests are handled by Apple.

License

You are granted a limited, non-exclusive, non-transferable license to use Nightproof on devices you own or control, for your personal, non-commercial use, subject to Apple's standard App Store EULA (the "Licensed Application End User License Agreement"), which is incorporated here by reference. To the extent there is any conflict, Apple's EULA governs.

Disclaimer of warranties

Nightproof is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of bugs, and we do not warrant that the challenges will reflect your actual state of impairment or your actual ability to make good decisions.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Nightproof, its developer, or its contributors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the app, including but not limited to drunk-purchases, drunk-messages, missed calls, vehicle incidents, decisions you make in reliance on the app, or any failure of the app to block what you expected it to block.

Your sole and exclusive remedy for dissatisfaction with the app is to stop using it.

Indemnification

You agree to indemnify and hold harmless Nightproof and its developer from any claim, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the app, (b) your breach of these Terms, or (c) your violation of any third party's rights, including any buddy you contact through the app.

Changes to these Terms

We may update these Terms from time to time. If a change is material, we'll note it in the app release notes. Your continued use of the app after a change means you accept the new Terms.

Governing law

These Terms are governed by the laws of the State of California, USA, excluding its conflict-of-laws principles.
